Los proveedores con sede en la UE est\u00e1n sujetos al Reglamento General de Protecci\u00f3n de Datos (RGPD), que ofrece s\u00f3lidas protecciones de la privacidad y claras salvaguardias jur\u00eddicas.<\/p>\n\n\n\n<p>En cambio, los proveedores estadounidenses est\u00e1n sujetos a leyes como la <a href=\"https:\/\/www.justice.gov\/criminal\/cloud-act-resources\" target=\"_blank\" rel=\"noopener\">Ley CLOUD <\/a>y <a href=\"https:\/\/www.congress.gov\/crs-product\/R48592\" data-type=\"link\" data-id=\"https:\/\/www.congress.gov\/crs-product\/R48592\" target=\"_blank\" rel=\"noopener\">FISA 702<\/a>que permiten a las autoridades estadounidenses acceder a los datos, aunque est\u00e9n almacenados en Europa. La Ley CLOUD permite a las fuerzas de seguridad solicitar datos a los proveedores de servicios con una orden judicial para investigaciones penales. La ley FISA 702 permite la vigilancia sin orden judicial en el extranjero y, en 2024, su \u00e1mbito de aplicaci\u00f3n se ampli\u00f3 dr\u00e1sticamente mediante la ampliaci\u00f3n de la definici\u00f3n de \"proveedores de servicios de comunicaciones electr\u00f3nicas\" (ECSP, por sus siglas en ingl\u00e9s) para incluir pr\u00e1cticamente a cualquier entidad con acceso a infraestructuras de comunicaciones digitales. Estos cambios plantean serias preocupaciones para las empresas y los ciudadanos de la UE que conf\u00edan en los servicios en la nube con sede en Estados Unidos, ya que corren el riesgo de violar el cumplimiento del GDPR y exponer sus datos confidenciales a actores estatales extranjeros.<\/p>\n\n\n\n<p>Especialmente en tiempos de inestabilidad pol\u00edtica -como sanciones, disputas comerciales o extralimitaciones en la vigilancia-, elegir un proveedor con sede en la UE garantiza el cumplimiento de la legislaci\u00f3n local, protege contra las interrupciones del servicio o la volatilidad de los precios y refuerza la soberan\u00eda digital al mantener las infraestructuras cr\u00edticas dentro de las fronteras de la UE.<\/p>\n\n\n\n<p>M\u00e1s all\u00e1 de las cuestiones legales y de privacidad, elegir un proveedor local tiene ventajas pr\u00e1cticas. Puede beneficiarse de una latencia menor y de un servicio de atenci\u00f3n al cliente en su zona horaria e idioma.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Por qu\u00e9 son importantes el bloqueo de objetos y las pol\u00edticas de ciclo de vida<\/h3>\n\n\n\n<p>El bloqueo de objetos es crucial para proteger los datos de borrados o modificaciones accidentales o malintencionados (por ejemplo, por ransomware), especialmente en entornos con requisitos de cumplimiento estrictos como los sectores gubernamental o sanitario. Impone un comportamiento de escritura \u00fanica, lectura m\u00faltiple (WORM), garantizando que los registros cr\u00edticos permanezcan inmutables durante un periodo de retenci\u00f3n definido.<\/p>\n\n\n\n<p>Por otro lado, las pol\u00edticas de ciclo de vida ayudan a automatizar la gesti\u00f3n de datos eliminando objetos cuando ya no son necesarios. Aunque el SSE puede ser eficaz contra el acceso f\u00edsico no autorizado a nivel de infraestructura, no protege contra credenciales comprometidas o amenazas internas.<\/p>\n\n\n\n<p>El cifrado del lado del cliente, en el que se cifran los datos antes de cargarlos, puede ayudar a reducir estos riesgos.
